Recently a large fire took place at a waste oil depot causing extensive damage to the site resulting in a bulk oil storage tank failing. Secondary containment then also failed due to fire damage, causing tens of thousands of litres of waste oil being released to the surrounding environment.
The incident was notified via the 24-7 Level 1 response service on a Saturday morning and OHES Environmental immediately contacted staff at the site, assessed the situation and arranged for a UK Spill accredited emergency response contractor to attend the site.
On arrival to site the waste oil was found to have severely impacted the depot and damage has extended to the adjacent development plot.
After formulating an appropriate strategy OHES, coordinated containment and collection works to prevent further spreading of the waste oil. Works continued through the weekend and during the following weeks to recover and remove waste oil and oil impacted materials.
The rapid, proactive and informed approach enabled us to mitigate the damage and control claims costs and the subsequent completed investigation, indicated that the emergency response works had significantly limited the extent of contamination and environmental damage.
Our client was not negligent in causing the incident and, as such, they were not legally liable to pay for the cost of cleaning up the third party land. However, they will be responsible for the costs if they are forced to clean the pollution up under an enforcement notice from the Environment Agency.
It is here that the OAMPS Policy is far superior to many others, our limit of indemnity for Statutory Environmental Liability is up to the same level as the Public Liability, many other insurers restrict the cover to sub limits as low as £250,000, which in this case would not have been sufficient to deal with the loss.

A BBC film crew recently captured footage of an incident being managed by OHES. The documentary team were following Hampshire Fire Service when they were mobilised to the scene of an overturned tanker. The tanker rolled onto its side in a gulley, near to a popular fisheries lake.
The cameras rolled as up to 2,000 litres of kerosene gushed from the tanker and fire crews attempted to contain the spillage. We mobilised a UKSpill Accredited contractor to the incident whilst our own staff communicated with site.
The incident was resolved with much praise and a subsequent programme of remediation and monitoring continues in this environmentally very sensitive location.
